It is protocol in the days leading up to the Inauguration for the President Elect and the Vice-President Elect to call upon the Justices of the United States Supreme Court. But how many of our prior President-Elects had cases pending before the Court where the President Elect is a named Defendant.
On January 14th, without the presence of media, the Chief Justice and the eight Associate Justices met behind closed doors with Barack Obama (aka Barry Soetoro) and Joseph Biden, both of whom are named Defendants in multiple lawsuits throughout the country, which are challenging the Constitutional eligibility of Barack Obama’s Presidency. In so meeting with a named Defendant, were legal professional responsibility rules violated.
From the American bar Association’s Code of Judicial Conduct (2007):
JUDGE SHALL UPHOLD AND PROMOTE THE INDEPENDENCE, INTERGRITY, AND IMPARTIALITY OF THE JUDICIARY, AND SHALL AVOID IMPROPRIETY AND THE APPEARANCE OF IMPROPRIETY
While the meeting in and of itself may not have been improper, the appearance of impartiality and of avoidance of impropriety are tantamount. With the number of cases pending, the proper protocol would have been for the Supreme Court AND the President Elect to have acknowledged that this meeting would be improper and it should have been cancelled. There are, after all, conference discussion scheduled on Obama citizenship cases tomorrow (01/16) and on January 23rd.
Just makes the cases all the more interesting and dynamic!

After meeting privately to discuss the cases the US Supreme Court would hear, or to issue Writs of Certiorari upon, the list of cases denied or granted was issued late Friday afternoon (Dec. 5th), and the Leo Donofrio case questioning President-Elect Barack Obama’s citizenship and Presidential eligibility was not on EITHER list.
A spokesman for the Supreme Court said that no decision had been reached as of yet, and that a decision from the Justices would most likely be forthcoming in the next week or so.
Unlike other cases, such as Pennsylvania attorney Philip Berg’s case, which allege that Obama was NOT born in Hawaii, the Donofrio case concedes Obama’s verbal assertion that he was born in Hawaii, but Donofrio claims that Obama’s British citizenship, afforded to him as the son of a British subject, precludes him from being the President. Barack Obama Sr., as a Kenyan citizen, was automatically a British citizen, since Kenya was a part of the British Commonwealth.
Other cases are still pending in the lower courts, including the lawsuit brought by Presidential candidate Alan Keyes against California’s Secretary of State to stop the certification of the State’s Electors. Each of the cases that have been filed throughout the country have the potential of being heard in the Supreme Court, based upon their outcome at the lower court and appellate level.
Since the Director of the Hawaii Dept. of Health stopped short of stating that the documents on file in Hawaii state that Barack Obama was born in Hawaii, the only satisfactory resolution to the “birthplace” part of the citizenship question would be for Barack Hussein Obama II to authorize the Hawaiian authorities to release the vaulted documents.
The Electoral College can, though it is unlikely, vote by conscience, based upon the Obama team’s like of candor in this matter, and not vote for Obama. Some states require their Electors to the Electoral College to vote as the state voted, but others allow the Elector’s a bit of discretion in their votes. In fact, a massive lobbying effort directly to the Electors in some states has been going on since November 4th.
Although President-Elect Obama has resigned his Senate seat, a move which is irreversible, it is noteworthy that Sen. Joe Biden has not yet resigned his seat, nor has Rep. Rahm Emanuel, and Sen. Hillary Clinton has said that she will not resign until she is confirmed as Secretary of State by the Senate. Senator Clinton’s decision not to resign just yet is completely understandable, but if their is such certainty in Obama’s election, one has to wonder why Sen. Biden and Rep. Emanuel have not resigned their positions.

GM, Ford and Chrysler have taken their public lashings, returned to Detroit, sharpened the pencils, and are now HYBRID-driving themselves back to Washington DC, the tin cups in tow, for a piece of the bailout pie. Co-President Elect Barack H. Obama addressed the Governor’s Meeting in Pennsylvania this morning, first with cameras present, then behind closed doors so he could “listen” to the needs of the Governors. In 43 states, there is a budget shortfall, and the Governor’s appear poised to ask the Co-President Elect for $170 billion dollar bailout as well.

To their credit, and ultimately as a key focus in their possible bid for the Republican Presidential nomination in 2012, Gov. Rick Perry of Texas and Mark Sanford of South Carolina co-authored an OpEd piece in today’s Wall Street Journal in which they state that this bailout mentality IS NOT the American way. The two Governors wrote:
“As governors and citizens, we’ve grown increasingly concerned over the past weeks as Washington has thrown bailout after bailout at the national economy with little to show for it.
In the process, the federal government is not only burying future generations under mountains of debt. It is also taking our country in a very dangerous direction — toward a “bailout mentality” where we look to government rather than ourselves for solutions. We’re asking other governors from both sides of the political aisle to join with us in opposing further federal bailout intervention…
In a free-market system, competition and one’s own personal stake motivate people to do their best. In this process, the winners create wealth, jobs and new investment, while others go back to the drawing board better prepared to try again.
To an unprecedented degree, government is currently picking winners and losers in the private marketplace, and throwing good money after bad. A prudent investor takes money from low-yield investments and puts them in those that yield better returns. Recent government intervention is doing the opposite — taking capital generated from productive activities and throwing it at enterprises that in many cases need to reorganize their business model.
In Texas and South Carolina, we’ve focused on improving “soil conditions” for businesses by cutting taxes, reforming our legal system and our workers’ compensation system. We’d humbly suggest that Congress take a page from those playbooks by focusing on targeted tax relief paid for by cutting spending, not by borrowing.
In the rush to do “something” to help, federal leaders would be wise to take a line from the Hippocratic Oath, and pledge to do no (more) harm to our country’s finances. We can weather this storm if we commit to fiscal prudence and hold true to the values of individual freedom and responsibility that made our nation great.”

So. Carolina Gov. Mark Sanford
Even as the Governor’s convened their meeting, California’s Governator Arnold Schwarzenegger declared a finincial state of emergency, an action that forces the legislature to address the state’s financial situation within the next 45 days. (On a humorous side note, do we think the Co-President Elect and the Governator discussed Obama’s fitness needs, in light of Arnold’s campaign comments about Obama’s policies needing some “meat”?)

Co-President Elect Obama and his YesMan Biden have not been sworn in yet, and Co-President Hillary Clinton has not been confirmed by the Senate yet, and already the posturing for 2012 can be seen. It will be important to watch the key players, particularly the Republicans like Gov. Tim Pawlenty, Gov. Rick Perry, Gov. Mark Sanford, Gov. Sarah Palin, Rep. Paul Ryan, and Gov. Bobby Jindal during the next two years, and what effect that they will have on the midterm elections in 2010.

Throughout the campaign season, Jack and Jimmy McCain were very rarely mentioned or seen on the campaign trail. One McCain son at the United States Naval Academy and another had been on a tour of duty in Iraq, Sen. McCain used their military status very rarely. Only in the waning days and weeks of the campaign did we hear Cindy McCain speak of their service from a mother’s perspective.
Gov. Sarah Palin’s son, Track, was sent off to Iraq just a week or so after his mother was named and nominated as the Republican Party’s Vice-Presidential nominee. The Governor would say in her speeches that John McCain was the type of Commander-in-Chief that she wanted leading her son.
And in early October, a choked up Sen. Joe Biden of Delaware, now the Vice-President-Elect, spoke to send off a group of the Delaware National Guard for a tour of duty in Iraq. Included in the troops was his eldest son, Joseph “Beau” Biden III, the Attorney General for Delaware. At 39, the father of two is fulfilling his commitment to the service of his country.

When Sen. Biden was elected as the Vice President on November 4th, 2008, his Senate seat became a target because the Governor of Delaware would have to name a replacement for the Senator, with the replacement holding the seat until the General Election in 2010. Sen. Biden was also reelected to his Senate seat on November 4th, and upon resigning his Senate seat, the Democratic Governor will name his successor.
Rumors have surfaced that Sen. Biden is lobbying the Governor’s office to name Beau Biden to his Senate seat. Sen. Biden had said that he did not want his son going to Iraq, a war that he did support. Now trying to have his son named as his replacement, is the Senator using this as a means of getting his son home early from his commitment. Or, in the alternative, will the six term Senator’s son be named as his replacement, yet fulfill his duties in Iraq, as other Senators and Congressman did in WWII. In that instance, Delaware would not be fully represented in the United States Senate. Delaware may also appoint a replacement with the political favors in place to permit Beau Biden to run in 2010 without a Democratic opponent.
It should be remembered that Obama and Sen. Biden owe Beau Biden for using his office as Attorney General to manipulate grand jury charges against Larry Sinclair, the Minnesota man who had sex and drugs with Obama in 1999. Just days before the DNC Convention, Beau Biden’s office dropped all charges against Larry Sinclair.
Just as the Delaware Governor will need to name a replacement for Sen. Biden, the Illinois Governor will need to do the same thing to replace President-Elect Barack Obama. Although it has only been 5 days, neither Senator has submitted their resignation so their Governor can name a replacement, and Obama’s Chief of Staff Rahm Emanuel would not comment today as to whether either Senator would participate in the lame duck session of Congress next week. It is unlikely that they will. With a December 1st deadline to respond to the United States Supreme Court in Berg v. Obama, and the possibility that the Court may rule against Obama, it is possible that Obama does not want to resign from his Senate seat.

In talking with Joe Scarbrough, MSNBC’s Hardball host, Chris Matthews, said that it is now HIS job as a journalist to MAKE sure this PRESIDENCY is SUCCESSFUL!!
Edward R. Murrow, the journalistic ethicist, would be appalled that a journalist felt that thier role exceeded the boundaries of REPORTING the news.
Mr. Matthews, Barack H. Obama is a wonderful orator, and yes, his orations can be inspiring. But they are not inspiring enough to make 48% of the public want to accept his socialistic platform, and if even a small percentage of the 52% who were moved to vote for Obama had any clue about what his platform will actually do to our Democracy, John McCain would be planning his transition today.
Mr. Matthews, despite the tingles that Obama sends down your leg (a sensation that other males have reported on the internet as well) it is NOT your job to make Obama successful. Your job is to make sure that the public is informed in an unbiased manner to make sound informed decisions about our elected officials. Thus, Mr. Matthews, OUR JOB is to make sure you are UNSUCCESSFUL at your self annointed job.

Americans went to the polls today to elect the 44th President of the United States, and with the election of Sen. Barack H. Obama to the office, Lady Liberty Democracy has passed away.
The United States, in electing Obama as President, has elected a biracial man for the highest office in the land, choosing the inexperienced orator over the proven record of his opponent, Sen. John McCain. After touting the race card that McCain refused to use, the Obama machine put forth a great effort of intimidation, online and at the polls.
In the election of Obama, the principles of our forefathers regarding our liberties and our Democracy will be tested to their core, given his socialistic view of economics, his desire to diminish the defense throughout the world, we have exchanged our intense American spirit for one that satisfies the reparations of racial injustice.

As the American electorate heads to the polls across our great nation, it is reported that Lady Liberty Democracy is gravely ill. From malfunctioning poll machines, to Black Panthers blocking the doors of Pennsylvania polling sites carrying night sticks, issues are cropping into the election process. These are just the tip of the iceberg for Lady Liberty Democracy.
Abuses of power and excessive greed have had a crippling effect on her health and welfare. Our elected leaders have taken great mortgages in exchange for turning a blind eye to the fraud and abuse in the mortgage industry, as well as on Wall Street. Our Commander in Chief has kept this nation safe from another terrorist attack for seven years, and despite strategy miscalculations in the Iraqi war, the Commander had to fight the Democrats to get us to the great place we are today in the Iraqi theater.
Lady Liberty Democracy has already suffered the tragic loss of one of her offspring during this electoral process. We have witnessed firshand the demise of the concept of journalistic ethics, having reporters make the news instead of reporting the news. As declared and announced by Sean Hannity of FOXNews, journalism died in 2008.
The prognosis for Lady Liberty Democracy is wholly and completely dependent upon the votes cast today. For her survival, this nation must infuse her with a rousing return to the morals and values that were the foundation of this nation’s early history. The conservative values, the nation’s faith, and our belief in the rights and freedoms our country stands for are fundamental to her recovery. Therefore, it is a moral imperative that we vote our conscience, for the future of our nation, and we must make sure that the message is clear that we are a nation dedicated to the true principles of a federal fovernment and sovereign state gove

“Tito the Builder” is angry that the media and other groups have investigated the background of “Joe the Plumber” whose major crime was that he asked Sen. Barack Obama a question that was not on the script.
Reacting to the various news stories about the invasion of Joe the Plumber’s privacy, such as checking his child support status, Tito Munoz believes (rightly so) that the mainstream media has failed to do the same similar investigation on Barack Obama.
On FOXNews “Hannity and Colmes”, Tito the Builder said that if under an Obama presidency he might get a tax break of $2,000 a year, that is 96 CENTS an hour and “my freedom is not worth that” to elect Barack Obama!

Latching onto Sen. McCain’s “Joe the Plumber” and the attention it has brought, Sen. Obama has added his own variation on the campaign trail. In North Carolina, Sen. Obama mentioned Suzie the Student, Nancy the Nurse, and Carl the Construction Worker, among others.
In his attempt to paint John McCain as “out of touch” with the economy, despite the narrowing polls showing otherwise, Barack Obama is telling crowds that “I don’t know what’s next. By the end of the week, he’ll be accusing me of being a secret communist because I shared my toys in kindergarten (before they had sex education in kindergarten). I shared my, uh, peanut butter and jelly sandwich.”
McCain spokesman Tucker Bounds, who has shown that he is far better at handling critical questioning that Obama’s Bill Burton, responded to Obama’s toy comment with “No one cares what Barack Obama does with his toys, but Americans do care that he wants to raise taxes, add a trillion dollars in new spending and redistribute your hard-earned paycheck as he sees fit.”
Tucker Bounds is absolutely correct Sen. Obama. We don’t care how you share your toys or your food (as long as its not to our enemies). We don’t care that your running mate makes millions more than Gov. Palin, yet the Palin’s are far more charitable with their middle class earnings than you and Michelle or Joe and Jill are with your “rich” earnings.
We DO CARE about how you want to say how and who we will share our toys, food, earnings with, instead of allowing US to decide what we will do with our earnings. In 1992, a little known Governor promised a tax cut for the middle class or promised that we would have no tax increase. Yet just 26 days into his administration, in February 1993, President Clinton signed a tax increase. You promised to participate in the public election financing, then broke your word, so we know that we cannot trust what you are now saying about our middle class tax relief.
Sen. Obama, if you are elected, I am selfishly saying that I am not sharing my toys!!

With five aggressive days left in the long fought battle for the White House. Gov. Palin tells Elizabeth Vargas of ABC’s 20/20 that she’s not going to be waving any white flag if surrender!! Not for Tuesday’s election outcome, and certainly not for her political future!
In the interview with Vargas, Gov. Palin expresses the fact that she will continue to be a visible and viable leader within the Republican Party. “I think that, if I were to give up and wave a white flag of surrender against some of the political shots that we’ve taken, that would . . . bring this whole . . . I’m not doing this for naught.”
Her friends and colleagues in Alaska do not see the Governor as disappearing back to polar ice caps in retreat either. Many have gone on various talk shows to express their opinions of how Gov. Palin was treated by the media, and how, from her history, this entire experience will serve as her foundation on the national scene.
If Gov. Palin changes titles in January and becomes the Vice-President, we can expect to see her as a visible entity of the administration policies. The strategists will work carefully with the President and Vice-President, as well as the Republican leadership, to make sure that she is able to take the reigns from McCain after his term(s) in office. Sen. McCain noted his confidence in Gov. Palin’s ability, in his choice, and in her future on the Larry King Live show.
So for all the media and pundits who so quickly vetted Gov. Palin (unlike Obama), and who have been so quick to try to send her packing back to Wasilla, Alaska, Sarah Palin, the “Barracuda”, is not leaving the stage anytime soon!
