SAN FRANCISCO (AP) — The so-called birther movement was dealt another legal blow Thursday when a federal appeals court tossed out a lawsuit challenging President Barack Obama’s U.S. citizenship and his eligibility to serve as commander in chief.
The 9th U.S. Circuit Court of Appeals ruled that none of the challengers had legal standing to file the lawsuit on Jan. 20, 2009, the day Obama was inaugurated. The three-judge panel cited various reasons for disqualifying six sets of plaintiffs, who included Obama’s political rivals, taxpayers and military personnel.
The birther movement has filed multiple lawsuits over the issue, so far with no success. Its leaders have lost similar challenges before the U.S. Supreme Court and the California Supreme Court.
The U.S. Constitution says only “a natural born citizen” may serve as president. The challengers allege that Obama, whose father was Kenyan, was born in that African country, rather than the U.S. state of Hawaii. They claim his Hawaii birth certificate is a forgery.
The appeals court didn’t address the authenticity of the birth certificate, instead ruling that the challengers couldn’t show “concrete injury” from the allegations.

NAIROBI (AFP) – Kenya has tightened security around the home of US President Barack Obama’s step-grandmother after the killing of Osama bin Laden, an official said Thursday.
“In the wake of security challenges including terror threats, I can confirm that we decided to enhance security at the home of Mama Sarah … ,” said regional administrator Francis Mutie, using the popular name for Obama’s step-grandmother who lives in western Kenya.
There have been no direct threats against the family but Kenya is on alert following warnings from Al-Qaeda followers after bin Laden was killed by US special forces in Pakistan on May 2.
“All visitors going to the home will have to be thoroughly vetted. They will undergo security screening before they are cleared to visit the home,” Mutie said.
“Everybody, including relatives, must comply to make the work of security personnel easier,” added the official. “On top of the security that was given, we will also provide more security in terms of escort for Mama Sarah.”
The elderly Sarah Obama’s homestead has been guarded since her step-grandson was elected president in 2008.

Orioles designated hitter Luke Scott, long an outspoken advocate for the Second Amendment, went much, much further than defending the right to bear arms in a wide-ranging interview with Yahoo Sports that included Scott saying he believes President Obama was not born in the USA.
Scott, who chatted with Yahoo when he stopped by baseball’s winter meetings in Orlando for a meeting with his agent, says Obama “does not represent America. Nor does he represent anything what our forefathers stood for.” When Yahoo’s David Brown, as a follow-up, asked him, “You don’t think that Obama wasn’t born in the United States, do you?” Scott replied:
He was not born here. … That’s my belief. I was born here. If someone accuses me of not being born here, I can go — within 10 minutes — to my filing cabinet and I can pick up my real birth certificate and I can go, “See? Look! Here it is. Here it is.” The man has dodged everything. He dodges questions, he doesn’t answer anything. And why? Because he’s hiding something.
You know what? People who have bad intentions, people that are deceivers or are not of honor and integrity — that’s how they act. I’ve seen it in every — it doesn’t matter what level. It can be in politics, it can be in business, it can be in sports, it can be in the construction field. Doesn’t matter. It’s all the same attitude. It’s the same thing.

Britain feared that the election of Mr Barrack Obama as US president could hurt London’s relations with America because of the way Mr Obama’s grandfather was treated by the British, according to leaked secret diplomatic documents.
Britain feared that its so-called “special relationship” with the US would come under strain because of Mr Obama’s history, his relative youth, which gave him no historical experience with World War II or the US cold war alliance with London.
Britain was also worried about its colonial forces’ treatment of Mr Obama’s grandfather, Mr Hussein Obama who was actually jailed before Kenya gained independence.

Fox News is partly to blame for spreading the idea that President Obama wasn’t born in the United States, White House senior adviser David Axelrod said Wednesday.
“I find the whole thing bewildering, but there is that strain, and it’s always been there in our politics,” he said on CBS’s “Late Show with David Letterman.”
He added, “These are times of great change and stress, so you see some of those things come out, but it is no doubt promoted by our friends at Fox and others, and that’s part of the politics we have to deal with.”
