Article III, Sec. 2, clause 2 says:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction…
“Original” jurisdiction means the power to conduct the “trial” of the case (as opposed to hearing an appeal from the judgment of a lower court). You all know quite well what a “trial” is – you see them all the time on TV shows: Perry Mason, Boston Legal, The Good Wife, etc. Witnesses testify and are cross-examined, etc.
The style of the Arizona case shows quite clearly that the named defendants are:
State of Arizona; and Janice K. Brewer,
Governor of the State of Arizona, in her
Official Capacity, Defendants.Does anyone read the U.S. Constitution these days? American lawyers don’t read it. Federal Judge Susan R. Bolton apparently has never read it. Same goes for our illustrious Attorney General Eric Holder. But this lawyer has read it and she is going to show you something in Our Constitution which is as plain as the nose on your face.

Judge Susan Bolton is a Clinton appointee, after her first decison they called in her marker.
Go back and read the “Mean Streak.” They are not above threatening anyone or worse and I could name some things but I don’t want to upset the obots.

Hey All,
My take on this goes like this:
The Feds are suing the State, because the responsibility for prosecuting illegals lies with the Feds, and the State is trying to take that responsibility away from the Feds.
The problem I have with this is that the Feds are not holding up their end of the bargain. The borders are not secure, and the illegals who are here, are not pursued.
Why don’t Feds use the same argument about drug enforcement? Why the double standard? Why is it that the Feds say it is their responsibility to prosecute illegals, but the drug war is a Federal responsibility, and the Feds allow local police to enforce drug laws.
The Feds get to pick and choose which laws they will allow local police to enforce?
The hypocrisy in our Government never ceases to amaze me.
Justice drops the case involving the voter intimidation issue, but the Feds pursue a State simply asking people within that State to produce a document proving they are legal.
Why do I have to produce a drivers license when I’m pulled over? The officer should “assume” that I am eligible to drive and “trust me” when I tell him/her my name.
This whole suit is ridiculous.
